Washburn v. J. Larson Homes, LLC

Christopher Staley and Jeff Baker recently obtained summary judgment in a construction defect case in Johnson County, Kansas.  Plaintiffs alleged that a general contractor was negligent in building a home in the Mills Farm subdivision of Overland Park.  Plaintiffs were claiming in excess of $2 million dollars in damages.  Chris and Jeff successfully argued that the statute of limitations barred plaintiffs’ lawsuit.  The trial court agreed with SWR’s position and found that the plaintiffs had knowledge of the alleged defects but waited until outside the statute of limitations to file their lawsuit.  Accordingly, the trial court granted SWR’s motion and dismissed plaintiffs’ claim.  This was a terrific win for SWR’s client and Secura.
